Criminal Diversion

We believe that accountability and rehabilitation come in different forms and can be just as effective in protecting the public.

Minimum Criteria

The purpose of the diversion program is to reduce the collateral consequences associated with a criminal conviction. It is designed to address the underlying cause of unlawful or harmful behavior while holding individuals accountable for their behavior.

By implementing alternatives to prosecution and incarceration, we mitigate the moral, social and economic costs of mass incarceration that disproportionately harm poor communities and communities of color. Our diversion program utilizes science-and community-based solutions proven to build public trust in the criminal legal system.

Acceptance into the diversion program is at the sole discretion of the Fayette County Attorney with the exception of individuals charged with domestic violence offenses and Driving Under the Influence (DUI) charges, who are ineligible to participate, based on court rules.
