How to File a Criminal Complaint
Misdemeanors matter! However, they often arise from conflict unobserved by police and require the victim to initiate the process to hold individuals accountable for any criminal behavior that was committed.
*We cannot accept criminal complaints without a police report. If you have not done so, please make a police report before continuing.*
The Fayette County Attorney’s Office is not an investigative agency. We do not have the authority to conduct independent investigations into potential crimes. Our office reviews submitted private criminal complaints to determine if they meet the legal requirements to proceed to a criminal court.
Before submitting a complaint, please review the following guidelines. If your situation falls into any of these categories, please do not file a complaint here, as it will not be processed by our office.
Felony Theft or Fraud: If your complaint involves a loss of more than $1,000, it is classified as a felony. These cases must be investigated and charged by a police detective.
Domestic Violence: All complaints related to Domestic Violence must be investigated and charged by a police detective.
Felony Assault: If your complaint involves a weapon, or if the injuries required hospital admission for more than 24 hours, it is a felony assault and must be handled by a police detective.
Firearm Offenses: If a firearm was pointed at you, this constitutes a felony Wanton Endangerment offense and must be investigated by a police detective.
Court/Legal Disputes: Our office does not file complaints related to perjury, alleged false statements in court, or allegations regarding EPO petitions. These matters must be addressed directly by a judge in court.
Traffic Accident Damages: We can assist with “No Insurance” complaints, which result in fines for the defendant. However, our office cannot recover restitution for damages to your vehicle. To recover financial damages from a traffic accident, you must file a small claims civil action in District Court.
If your case does not fall into the above categories, you may proceed with your submission. Once submitted, our staff will review your case and follow up with you as soon as possible.
